Remember when you were a child and you could just run and run and run without getting tired?  You could play the entire day and still have energy to spare!  You probably drove your parents up the wall…and now, you are the parent and you wonder where that energy went!  You watch your own children run and play all day and you wonder what happened to you!

You stop and imagine…If I could just bottle up my kids’ energy and sell it…

5 Hour Energy, Monster, Rock Star, Red Bull and many others have been doing just that for years…and doing it well!  The energy drink market is HUGE! I don’t think anyone can deny that!

We are all in search of more energy, and for years, these products have provided a temporary solution to that need.  But at what cost?

Generally, energy drinks include methylxantines (a big word for stimulants – including caffeine), vitamin B and herbs.  Other common ingredients are gaurana, acai, and taurine, plus various forms of ginseng, malodextrin, carbonated water, inositol, carnitine, creatine, glucuronolactone and ginko biloba.  Some contain high levels of sugar and many brands also offer artificially-sweetened “diet” versions.  The central ingredient in most energy drinks is caffeine, the same stimulant found in coffee or tea, often in the form of guarana or yerba mate.

A variety of physiological and psychological effects have been attributed to energy drinks and their ingredients.  Two studies reported significant improvements in mental and cognitive performances as well as increased subjective alertness.  Excess consumption of energy drinks may induce mild to moderate euphoria primarily caused by stimulant properties of caffeine, however, may also induce agitation, anxiety, irritability and insomnia.

There are however, some adverse affects of consuming too many energy drinks…

In the US, energy drinks have been linked with reports of nausea, abnormal heart rhythms and emergency room visits.  The drinks may cause seizures due to the “crash” following the energy high that occurs after consumption.  Caffeine dosage is not required to be on the product label for food in the United States, unlike drugs, but some advocates are urging the FDA to change this practice.

Adverse effects associated with caffeine consumption in amounts greater than 400 mg include nervousness, irritability, sleeplessness, increased urination, abnormal heart rhythms (arrhythmia), and stomach upset.  Energy drinks do not provide electrolytes, and have a higher likelihood of an energy “crash-and-burn” effect.  Caffeine in energy drinks can excrete water from the body to dilute the high concentrations of sugar entering the blood stream, leading to dehydration.  If the body is dehydrated by 1%, performance is decreased by up to 10%!

So how does one gain that energy without the adverse affects…I mean, we can’t all be kids again!

What exactly does all that energy the kids have come from exactly?  Quite simply…their own bodies!  Without even getting into technicalities, I’m sure we can all agree that as we age, things just don’t quite work as well as when we were younger.  We don’t recover as fast, we can’t just run for miles and miles…and then do it again, we need naps and Energy Drinks to get through the day!

We are learning more and more everyday about the benefit of antioxidants and the “feel good” effects of them.  This is because as our bodies age, the oxidation process builds up and slows us down.  It’s kind of like a lead pipe…over time, if not properly taken care of, oxygen begins to eat away at that lead pipe through oxidation and rust.  It starts to pit and basically eats itself and falls apart.  This is what we are doing to our bodies every day.  We are creatures that rely on oxygen to function…the downside is that we rely on oxygen to function, which creates oxidation, or rust, in our bodies.  As we get older, that rust starts eating away and we start turning to those energy drinks!

A child produces their own endless supply of energy because their body is functioning at its peak.  It has yet to suffer the adverse effects of oxidation and cell death.  They have enough ATP and mitochondria in their cells to produce all the energy they need to run and play without end!

ATP (adenosine triphosphate) is the most widely distributed high-energy compound within the human body.  This ubiquitous molecule is used to build complex molecules, contract muscles, generate electricity in nerves and light fireflies!  All fuel sources of Nature, all foodstuffs of living things, produce ATP, which in turn powers virtually every activity of the cell and organism.

This is the latest statement from the Max Blog as of 2/24/2010:

On February 17, 2010, Tripharma LLC (“Tripharma”) sued Max International, LLC and various current and former Max executives and employees (collectively “Max”), along with various Max associates. The suit claims that Max allegedly improperly and falsely marketed, advertised, and labeled the MaxWLX product as being the subject of certain scientific tests or studies and as being licensed under United States Patent No. 6,899,892 (the “’892 patent”). The suit also claims that Max allegedly violated a marketing and supply agreement between Max and Tripharma by not purchasing a minimum amount of a viscous polysaccharide product for Max’s MaxWLX.

Tripharma is seeking money damages from Max. TriPharma also seeks an injunction prohibiting Max from continuing to advertise, market, and sell the MaxWLX product and from using the tests or studies for marketing, advertising, or other purposes.

With respect to the various distributors, Tripharma is not seeking money damages from Max’s distributors. Instead, Tripharma is only seeking an injunction prohibiting the associates from continuing to advertise, market, and sell the MaxWLX product, and from using the tests or studies for marketing, advertising, or other purposes.

Max believes the suit is without any merit, was filed for an improper purpose, was filed to attempt to damage Max’s reputation and business, and Max will seek, among other things, its attorneys’ fees and costs in defending the lawsuit. Max will vigorously defend itself, its business, its conduct, and its reputation in all lawful and appropriate manners, including, if appropriate, by filing counterclaims against Tripharma.

Xellex was researched and developed at the University of Minnesota where it was awarded Two (2) patents and clinically tested at the University of Connecticut. It is truly the HOLY GRAIL of over the counter weight loss products and will be available to the general public without a prescription for the first time via US DRTV commercials in May.

Evidently, Tripharma sells a product much like Max International’s MaxWLX product that helps to reset critical leptin sensitivity.  MaxWLX is one of three patented products from Max that include MaxGXL, a glutathione accelerator product, and N-Fuze, a multivitiamin, multimineral product that employs a patented nanotechnology delivery system.

As of the time of this post, a copy of the lawsuit is not yet available.  According to RFCexpress.com (Recently Filed Cases), it will be available sometime in the next few days.  We will post a copy here as soon as it is available.

I know Max believes they purchased all of the patent rights to this formula and breakthrough.  They have even defended what they perceive to be their rights.  So who is this Tripharma company?  Do they have some kind of valid claim?  It will be interesting to see how this lawsuit develops.
