This is the latest statement from the Max Blog as of 2/24/2010:
On February 17, 2010, Tripharma LLC (“Tripharma”) sued Max International, LLC and various current and former Max executives and employees (collectively “Max”), along with various Max associates. The suit claims that Max allegedly improperly and falsely marketed, advertised, and labeled the MaxWLX product as being the subject of certain scientific tests or studies and as being licensed under United States Patent No. 6,899,892 (the “’892 patent”). The suit also claims that Max allegedly violated a marketing and supply agreement between Max and Tripharma by not purchasing a minimum amount of a viscous polysaccharide product for Max’s MaxWLX.
Tripharma is seeking money damages from Max. TriPharma also seeks an injunction prohibiting Max from continuing to advertise, market, and sell the MaxWLX product and from using the tests or studies for marketing, advertising, or other purposes.
With respect to the various distributors, Tripharma is not seeking money damages from Max’s distributors. Instead, Tripharma is only seeking an injunction prohibiting the associates from continuing to advertise, market, and sell the MaxWLX product, and from using the tests or studies for marketing, advertising, or other purposes.
Max believes the suit is without any merit, was filed for an improper purpose, was filed to attempt to damage Max’s reputation and business, and Max will seek, among other things, its attorneys’ fees and costs in defending the lawsuit. Max will vigorously defend itself, its business, its conduct, and its reputation in all lawful and appropriate manners, including, if appropriate, by filing counterclaims against Tripharma.

As of the time of this post, a copy of the lawsuit is not yet available. According to RFCexpress.com (Recently Filed Cases), it will be available sometime in the next few days. We will post a copy here as soon as it is available.
I know Max believes they purchased all of the patent rights to this formula and breakthrough. They have even defended what they perceive to be their rights. So who is this Tripharma company? Do they have some kind of valid claim? It will be interesting to see how this lawsuit develops.

Since my post a few days ago regarding a founding distributor leaving Yoli, I’ve recieved many responses all asking the same two things: Who and Why?
…Time for an update…and to answer some questions!
So who is leaving? Me
Why would you leave such a successful launch? Read on…
All of the statements I made about Yoli in the post a few days ago are my honest opinions. I think that Yoli’s product is a great alternative to a lot of beverages out there in the marketplace today…MLM or otherwise! My kids love it and I feel better about them drinking Yoli vs. them drinking beverages filled with sugar! I will continue to order Yoli’s products and really look forward to future formulations.
Am I passionate about Yoli? Unfortunately…no.
Allow me to tell you how I got to where we are today with Yoli and where we have moved to…
As I stated in a previous post, I had knowledge of Yoli a little over a year ago. I have been working with Len Clements for almost 10 years…through the thick and thin!
I had been loyal to Len in Longevity Network, and when Len took the plunge to start his own company, I was fortunate to be a big part in that endeavor. I can’t tell you how much time and effort was put into the planning phases, pre-launch, launching, meetings and the ultimate downfall to the company. I won’t go into why the company failed, however, I can share with you that after Epic, the wind was taken out of my sails.
Being loyal, Len flew me out to Vegas to meet with two company owners of another company. To summarize…great products, great vision but not so great execution! Looking back, I know I was not committed 100% to that company…you see, the wind was just not strong enough and I was also a little apprehensive after the experience with Epic!
Well, of course, that company too had some challenges and this time, the wind just died! Again, I still didn’t hate the industry…I just wasn’t really excited by what was out there! I guess I had learned too much from Len and loved some of the aspects from previous companies that no other company out there offered! There just wasn’t anything that I really was passionate about.
A little more time goes on, and I join USANA with Len. I wasn’t excited…I wasn’t passionate…I liked the products, but they didn’t really change my life. I guess I just settled! You see, I love this industry. I love to work with and help others! I belong in this industry!
Unfortunately, the passion just still was not there.
Even as we join USANA, Len tells me that a few other things are on the horizon for us that may or may not pan out. If they don’t, then we are a part of a solid company with solid products. If they do pan out…then we just inform our groups of our decision to move elsewhere and the reasons why. So, how passionate do you think I was during that time?!
Well, around last October’ish time-frame, Len informs me that one of the possibilities will be becoming a reality. At this time, I still don’t know exactly what it is but I trusted Len when he assured me that this would be something we could get passionate about!
Over the next year, I start building towards the launch of Yoli! The wind picked up…we hoisted our sails and I got excited again. You see, my wife had been laid of from work and what better timing for us to get excited again! She was home…she was excited…I was excited…we just couldn’t wait for Yoli to launch.
Was there a small amount of reservations left in me? I suppose you could say that…however, those reservations slowly began to wain as we learned more about Yoli. When we got samples, that sealed it! We loved the taste, the kids loved the taste and we were now committed! Our pre-launch team was growing and every day was getting closer to the launch…nothing could stop us now!
Well…almost nothing!
In June of this year, I changed locations at work. Now, I’ll say this…I love what I do! I have a great job, great boss, solid company and changing locations was going to be for about 6 months…and it was great for my development (I just got promoted this past Friday!!!).
So what does this have to do with this story? Well, it really is just a time-marker. You see, a few months later I slowly started into a downward spiral that I didn’t see coming at all. I can’t explain it…I don’t know what brought it on! I had been fairly healthy…exercising, eating well and of course I’ve been taking some fantastic products from various MLM companies for years. Not to mention that we were excited about our budding Yoli business!
For whatever reason, I was not sleeping well…I had virtually NO energy…I was irritable at home — and worst of all, I had lost my “umph” that I have had my entire life. I just had no zest…no desire…no passion – and I couldn’t explain it and that just made it worse and worse.
I guess it is about mid-August now…aside from my slow demise, work is going well and I’m gearing up for my panel at the end of the month to show the senior mgrs of the company that I am capable of the promotion that I am seeking. You see, my job does require a certain amount of critical thinking, multi-tasking and concentration…all the while still having a high level of energy for the physical demands. Well, my panels go well and I’ve got my things to work on.
Here is where I really start getting concerned…
Physically, I’m getting worse. I have to stop at the service station before work to buy 2 Monster Energy drinks just to make it to lunch-time (at this time, I’m really looking forward to Yoli and it’s products!). I have to get 2 more Monsters at lunch-time to get through the rest of the day. I can’t focus, I’m exhausted and I’m really feeling “lost.” I’m concerned that something in seriously wrong with me and it is affecting not only my job, but my home life as well!
I struggle to stay awake driving on some days. I have no energy to play with the kids. I have no desire to do anything at all! I began to wonder if I was clinically depressed or if I had chronic fatigue or something. To put it mildly…I was scared!
So…I’m at an auction one day with a co-worker and we are chatting with Christy (the lovely woman who takes care of us at this auction). Completely out of the blue, she starts ranting and raving about this product that Jason (an acquaintance of ours) gives her to take. She was so happy about how good she felt and had been sleeping well and the energy she had that she was just beaming! I asked here what it was and she said she had no idea, but she was buying it! She found a website about it and I wrote it down and planned on checking it out when I got home.
When I got home, I checked out the site and it turns out that it is an MLM company. Well, we are committed to Yoli at this time so, I quickly dismiss it and don’t really look into it that much…
…but…Christy’s testimonial just kept eating at me!
I kept thinking to myself, Wow! Imagine that…network marketing working the way it is intended…a product that changed someone’s life in such a positive way that she just starts raving about it!
Over the next week, I research it a little here and there…and I start getting interested in trying the product. Maybe it can help me the way it helped Christy! The next week at the auction, I find Jason and ask him about it. I tell him up front that I am only interested in the product as my wife and I have a new company coming up that we have been building with and have committed to. He tells me what the product did for his wife and how it helped her and that is why he got involved.
Well, I tell him that I’ll research a little more and probably order from his site soon. Another week or so goes by and the more I learn about this product…the more I’m in a difficult situation. You see, the sails were set…the wind was blowing with Yoli and I’m now learning more and more about this product that seems just too good to be true! My conscience is slowly eating at me…I’m committed to Yoli…we’ve got a good group going…and Yoli has some great potential!
I try to forget about this other product and just focus on Yoli…yea, I want to see if it will help me the way it helped Christy, but I’m terrified that it will work and I’ll be torn between two companies.
I’m on my way home from work one day and I catch the tail-end of a radio ad about Steven K. Scott and a home-based business. Well, out of curiosity, I call the number to see who in the area is running a radio co-op and what company it is.
When I get home I get a call from Rodney. Rodney tells me that he is calling to follow up with me requesting info from the radio ad. I tell him right away that I was just curious as to what company was doing a radio ad and he tells me that he is working with Max International. I say, oh, that glutathione company right? Needless to say, this is the company that I have been looking at to try this product!
Well, we chat for a while and he offers to give me some product to try. We agree to meet for lunch the next day. He gives me a week’s worth of product, a DVD, an audio CD and some literature. I tell him again that I am only interested in the product and that I am focused on building another company.
On the way home, as I listen to the audio CD, I keep thinking about Rodney and how green he is in this industry. He has a construction background and got involved with this company a little over a year ago and has had some pretty darn good success. I also think that he is going to go broke giving all this stuff out to people who only want to be a customer! Although…what is interesting is that this product made such a positive change for Rodney that he believes in it without fail!
In any case…I’m anxious to try this product…and I’m also subconsciously looking for a reason for this product to NOT work for me! Remember my conscience? I’ve got Yoli and I can’t have this product working for me!
So, I’m taking this product for a week and I have also searched on eBay to see if I could find some former distributors dumping all thier product for cheap. Well I end up buying a couple boxes (turns out that nobody is dumping product…they are selling it because they know that the customer will fall in love with it, but that’s another story…). The extra boxes I got are going to arrive right as my week supply is up and I plan on “testing” it on family and friends.
So, the week is almost up and I’m not sure what I’m going to say to Rodney about it not working — my conscience still wants this product to not work so I can feel good about focusing on Yoli. Well, a few days before I’m out, I get sick — like Flu sick! I’m excited…not because I’m sick, but because that is my excuse. I can tell Rodney that this crap made me sick and I can close the door on it forever and never look back! During this same week, my 8 year-old son tests positive for the darn swine-flu! So, maybe my sickness was the pig flu…I’ll never know.
Well, after an auction right near the end of this week, I’m on the golf course and Rodney sends me a text: “Are you taking your Max? How’s it working?” Here is my chance…I call him and tell him about my son and about how sick I just was and this stuff is junk!
Low and behold, Rodney insists that he get me another week and that I should take MORE to help get through the sickness! Dang…this guy is persistent…I had my out, but why did I not take it?
I guess I had not even realized it, but that week on that product (aside from the sick day), I started to feel better. I wasn’t drinking as many Monsters…but I didn’t really realize it because I still wasn’t “all better.”
So, I guess my sub-conscience answered for me and I agree to another week. Plus…I have the other boxes about to arrive and I can double the amount to power through the end of the sickness!
I guess it was about the 8th day or so…not exactly sure what day…but I remember waking up to go to work – BEFORE my alarm went off! Not only that, I sat up in bed and was astonished at the night of sleep I had just gotten. I mean I SLEPT! Like a baby…like a log…I had dreams…I was literally amazed at how I felt!
I drove to work and felt “alive!” I mean…I just felt fantastic! Not like bouncy or anything, just felt that everything was “working” – like I was in tune with my body and realized that everything was just right. Right in to work with no stop for the Monsters! The focus I had during that day was beyond amazing. I was no longer struggling to find the words to complete my sentences…I was using “big” words so fluently that I impressed even myself…I could multi-task and pay attention to so many things at once.
On the way home, I wasn’t struggling to stay awake. I had energy when I got home to interact with my family!
The next day was more of the same and the next day and the next. What still got me was the sleeping. I don’t know if I can accurately depict on this blog what I mean, but believe me when I say, I SLEPT! Just that alone still amazes me…not to mention my body just functioning correctly! I’m back!
So…now to “test” my family and friends. So those of you in the “NFL” club know how uncomfortable it is to go to all of your family to give them anotherproduct to try. Especially me since I’ve been working on Yoli for almost a year now! I mean dang, what kind of credibility does that show?!
Here is what I did…I gave a week supply to 4 different people: Mom, Step-dad (Steve), Mom-In-Law (Linda) and Father-In-Law (Mike) ***Jill (my lovely wife) is now taking the product as well but I can’t do the same test as she already has seen what this stuff is and can do***
I tell my test subjects: Take this stuff for a week. I didn’t tell them what it was…I didn’t tell them what it might do…I didn’t tell them to expect anything…I just said take it for the week and let me know if you notice anything at all, or if you experience nothing! I said that I know what it did for me and Jill and I need to make a serious decision between this product and Yoli.
In all my years in MLM, I’ve never experienced what happened next. With the exception of Mom, within the week, all of them wanted more…and I didn’t even have to ask!
Steve told me that he just felt like he had so much “vitality” throughout the day (his word…not mine!)
Linda can sleep at night and her arthritis pain was virtually gone!
Mike has never had trouble sleeping, but always woke up stiff as a board and really struggled to get his day going…he now jumps out of bed and is as fluid as water!
Mom took a little time…she has been taking anti-depressants (for help in dealing with the loss of a loved one and the final days of another) and she knows that she doesn’t want to keep taking them…especially with me hounding her to get away from drugs like that, but I understand the situation. Well, she doesn’t want to give them up because when she started taking them, she started sleeping…the same way that I had experienced and that she was afraid of losing that feeling! I kept pushing and guess what…she slowly stopped taking the drugs and she still sleeps every night like a baby!
Now, she didn’t notice this other thing, but I sure as heck did…you know those “senior moments?” Well, I LOVE talking with my mom…what can I say…I’m a Mommy’s boy! Lately though, it has been just frustrating! She could not complete a sentence…she couldn’t find the right words and she kept insisting that she was getting alzheimer’s! You know what…those “senior moments” that Mom has…are now gone. I can have a conversation withher without having to talk for both of us!
Test subjects completed. My personal testing completed. Jill’s testing completed! Decision made!
So why did a Founding Distributor with Yoli leave?
Quite simply…the Max GXL product changed my life! It worked so well for me and my family that we made what turned out to be a very easy decision to align ourselves with this company to make this product available to others like us! I am compelled to tell everyone and the passion is back! The sails are full!

Yoli has a product that everyone should be using…
…however, Max International has a product that everyone needs to be using!
I’ve been in the Network Marketing/MLM industry for many years now. I’ve been a part of the full gamut of companies: pre-launch, launch then fail, launch then successful, established companies. The knowledge and experience I have gained over the years from all of those experiences have been invaluable. One of the key things I have learned is this…the grass is not always greener on the other side!
I first spoke to Len Clements late in 2001. I had been home from the Marine Corps for almost two years and wanted to seriously get back into the MLM arena as I had dabbled with Herbalife, Excel and the Colloidal Minerals company (remember the Dead Doctor’s Don’t Lie cassette tape?) in the mid 90s.
Backtrack to early 2000, when my wife and I came home from the Corps, Dad was very sick with a heart disease and I stepped in to help run one of the family sadwich shops. A year later and I’m opening our third restaurant and welcoming our son into the world at the same time! A few months later, I’m having a conversation with my father that I just can’t do this anymore — I can tell you that was a tough one!
One of my best friends, Robby, calls me up one day and I hear the classic lines…Jayson and I just got involved in this new company and I want you to check it out! I was receptive (imagine that) and went to a meeting. Was this what I was looking for? Sort of…I joined…we had some success…I was beginning to really get a group going…I started researching and learning this industry.
The more I learned, the more I grew concerned about the company I was a part of. Turns out things were not so legal in what we were doing…classic pyramid…I was duped, but learned some valuable lessons! In this case, the grass was green for a while, and then turned to poo!
The moderate success I achieved in this company and the more I learned really sparked my desire for this industry…

One of the saddest things I see happening in this industry is the huge number of folks who wander aimlessly through this ever widening sea of network marketing opportunities. These are people who indeed find an island oasis from time to time, only to jump right pack into the cold, rough surf in search for a “better” paradise. As I watch them swim away, I know their fate. Another island, another return to the sea. Then finally, with no strength left to swim another stroke, their hopes and dreams for a better, more secure life through network marketing sinks to the ocean floor. But alas, there is no floor, for it has been covered, layer upon layer, by the drowned hopes and dreams of so many others before them.Or, we can liken these people to a marathon participant who runs the first of a 20 mile race, then sprints back to the starting line — over and over and over. Then stands confused and frustrated by his lack of progress (and, most likely, blaming the course, his shoes, the race promoters, the weather…).
You see, building a network marketing organization takes time. It takes patience. But what few distributors (in any opportunity) seem to realize is that it gets easier, it happens faster, as time goes on. But so few MLM distributors stick around long enough to see this happen. Think about it for a moment. You start out with one person building your organization — you! Then you sign up a couple friends. Now you have three people all working to build your organization. In a month or two you might have only twelve people in your downline. But that’s twelve people who could all contribute to your downline. The more your group builds, the more people there are to help build it even bigger.
This phenomenon, called geometric progression or “momentum,” does exist, and it can occur within your own personal downline much like it does for a company. After all, aren’t all the distributors in a company part of one really big downline? Your downline can go into momentum too, on a smaller scale of course. However, depending on your activity, the opportunity you’re involved in, and at least a little luck, this onset of your own mini-momentum might take three months, five months, perhaps a year. As long as you’re recruiting at least one new distributors every month or two, it is mathematically inevitable that your organizational growth will begin to accelerate on it’s own.
So let’s say, for the sake of example, that momentum would strike around the sixth month. How many people in this industry do you think are long gone from their opportunity before they even approach that sixth month? After all, they’re not rich yet, and the promises of all those other opportunities are just so enticing, aren’t they? Well, the answer is thousands. Thousands!
And how many hopes and dreams lie at the bottom of the MLM ocean? That’s right — thousands. It’s no coincidence.
The ocean’s cold. There’s sharks out there. Find a nice warm island, make it your home, and see what you can build on it.

Now, with all of the experiences I’ve had, the knowledge I’ve gained and the mentor that I’ve worked with for almost 10 years…why on earth would a founding distributor with Yoli (a company that is due to be a giant in the MLM industry) who has been building his Yoli organization for over a year (I was among the few who knew of Yoli from the VERY start)…decide to graze in a different pasture?
Maybe there is a different type of grass…
